Terms of Service

1.1 Age. You must be at least 18 years old and able to form a binding contract. Grace is not for minors, and you may not use it if you are under 18.

1.2 Where Grace is offered. Grace is operated from the United States and intended for use there. We make no representation that Grace is appropriate or available in other locations. If you use it from elsewhere, you do so on your own initiative and are responsible for complying with local law.

1.3 Your account. Grace creates an account for you automatically the first time you open the app, so you can use it without giving us your name or number. You may optionally verify a phone number so your account can be recovered on a new device. You are responsible for the device and phone number tied to your account and for everything done through it.

1.4 Prohibited users. You may not use Grace if we have previously disabled your account, or if applicable law bars you from using it.

1.5 Deleting your account. You can permanently delete your account and its data from inside the app at any time. Our Privacy Policy explains exactly what deletion covers and what it does not.

2.1 What Grace is. Grace is a faith-based sobriety and recovery app. It offers daily scripture and devotionals, prayer, journaling, sobriety and mood tracking, milestones, an AI companion, and a peer community.

2.2 Not medical or clinical care. Grace is an educational, motivational, and accountability tool. It is not medical, clinical, psychological, psychiatric, or therapeutic care. It does not diagnose, treat, cure, or prevent any condition, and it is not a substitute for professional help. Using Grace does not create a doctor–patient, therapist–client, or any other professional relationship between you and us.

2.3 Not pastoral care. Grace draws on scripture and prayer, but it is not pastoral counseling or spiritual direction and is not a substitute for your own faith community, clergy, sponsor, or recovery group.

2.4 Never change treatment based on Grace. Do not start, stop, or change any medication, treatment plan, or substance use because of anything you read in Grace. Withdrawal from alcohol and benzodiazepines in particular can be medically dangerous and needs medical supervision. Always talk to a qualified professional.

2.5 No promised outcome. We do not promise that Grace will produce any particular result, including sobriety, any period of abstinence, or any spiritual or emotional outcome.

3.1 Grace is not for emergencies. Do not use Grace — including the AI companion, the community, or journaling — to report a medical emergency or thoughts of suicide or self-harm.

3.2 Where to get help now. If you are in crisis or believe you may harm yourself or others:

• Call 911 or your local emergency number, or go to the nearest emergency room.
• Call or text 988 for the Suicide & Crisis Lifeline — free, confidential, 24/7.
• Call the SAMHSA National Helpline at 1-800-662-4357 for free, confidential, 24/7 treatment referral.

3.3 Nobody is watching in real time. Grace is not monitored by a person as you use it. No one at Koby Empire reads your messages as you write them, and we do not provide crisis response, welfare checks, or emergency dispatch.

3.4 We may act on serious risk. If we believe in good faith that there is a risk of serious harm, we may — but are not obligated to — take action consistent with law, including removing content, contacting you, or contacting emergency services or other resources.

4.1 What it is. Grace includes an AI companion built on third-party large language models. It is software. It is not a person, a clinician, a counselor, a sponsor, or a member of the clergy, and it has no professional training or judgment.

4.2 It can be wrong. Responses are generated automatically and may be inaccurate, incomplete, or wrong for your situation — including scripture references and how they are interpreted or applied. Verify anything that matters before relying on it. You are responsible for decisions you make based on what it says.

4.3 Not confidential in the legal sense. Your conversations with the AI companion are not protected by doctor–patient, therapist–client, clergy–penitent, or any other privilege or confidentiality obligation.

4.4 What we send to make it work. To generate responses and keep the feature safe, your messages — along with profile details you have given us, such as your name, how long you have been sober, the substances you are recovering from, your faith background, your goals and obstacles, and how you are feeling that day — are sent to third-party AI providers and to a memory service that lets the companion remember context between conversations. Our Privacy Policy names them. Do not submit anything you do not want processed this way.

4.5 Do not use it in a crisis. See Section 3. The companion may surface crisis resources, but it cannot summon help and cannot assess your safety.

4.6 Availability. We may change, limit, or discontinue the AI companion at any time, including applying usage limits.

5.1 The community is public to members. Your posts, comments, replies, prayer reactions, and community profile — nickname, avatar, bio, photo, and the sobriety length shown alongside them — are visible to every signed-in Grace member. Treat community areas as public. Do not post anything you need to keep private, including your full name, address, phone number, or other identifying details, and never post someone else’s.

5.2 Your content stays yours. You keep ownership of what you post. We claim no ownership of your community content, your journal entries, your prayers, your check-ins, or your conversations with the AI companion.

5.3 The license you grant us. For community content only, you grant Koby Empire a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, reformat, display, and distribute that content solely to operate, moderate, secure, and improve Grace. This license does not extend to your journal entries, prayers, check-ins, or AI conversations, which are never published.

5.4 Deleting what you have posted. You can delete any post you have published, and deleting your account removes your community profile, your profile photo, and the posts and comments you have published along with it. What no one can undo is another member having already read, replied to, or screenshotted something while it was up. If something you expected to be gone is still visible, email us at koby@sunflowersober.com.

5.5 What you promise about your content. You have all the rights needed to post it, it does not infringe anyone’s rights or break the law, and it is not another person’s private information.

5.6 Community standards. We have zero tolerance for objectionable content and abusive members. Do not post:

• Harassment, threats, bullying, hate speech, or content attacking anyone for who they are.
• Content that encourages, instructs, or glorifies suicide or self-harm.
• Content that glorifies or instructs substance use, or that offers, seeks, or arranges the sale of drugs, alcohol, or prescriptions.
• Sexual content, nudity, or graphic violence.
• Another person’s private or identifying information, or content that impersonates anyone.
• Spam, scams, advertising, recruitment, or solicitation of any kind — including for treatment programs, coaching, or fundraising.
• Anything unlawful, or anything that infringes someone else’s intellectual property.

5.7 Images are screened before they appear. Photos attached to posts, and profile photos, are automatically reviewed before they become visible to anyone else. Screening is automated and imperfect, and it is not a guarantee that everything you see has been vetted.

5.8 Other members are not professionals. The community is peer support. Other members are not clinicians, counselors, or clergy, and what they say is their own — not advice from us and not something we endorse or verify.

6.1 Reporting. Every post and comment has a report control. Reporting something sends it for immediate automated re-review, and content reported by enough separate members is hidden automatically.

6.2 What we do about reports. We review reports of objectionable content and, within 24 hours, remove content that violates these Terms and remove the member who posted it where warranted. You can also reach us at hello@sunflowersober.com.

6.3 Blocking. You can block any member from the menu on their post or comment. Their posts and comments stop appearing for you, and you can unblock them later from your profile. Blocking hides someone from your view — it does not stop them using the community.

6.4 Our discretion. We may remove or hide content, restrict features, or suspend or terminate accounts at any time, with or without notice, to enforce these Terms, protect members, or comply with law. We are not obligated to monitor content, but we may.

7.1 Paid features. Some Grace features require a paid subscription. What is included, the price, and the billing period are shown before you purchase.

7.2 The app stores bill you, not us. Subscriptions are sold and billed through the Apple App Store or Google Play, and managed on our behalf by RevenueCat. We never receive or store your card details.

7.3 Automatic renewal. Subscriptions renew automatically at the then-current price for the same period until you cancel. Your account is charged for the renewal within 24 hours before the current period ends, unless you cancel at least 24 hours before that point.

7.4 Free trials. Where we offer a free trial, cancel at least 24 hours before it ends to avoid being charged. Any unused part of a free trial is forfeited when you purchase a subscription.

7.5 Cancelling. Cancel any time in your Apple ID or Google Play subscription settings. Deleting the app does not cancel your subscription, and neither does deleting your Grace account.

7.6 Refunds. Refunds for store purchases are governed by Apple’s and Google’s policies and are issued by them, not by us. Except where the law requires otherwise, fees are non-refundable and we do not refund partial periods.

7.7 Price changes. We may change prices for future billing periods. Where required, the app store will notify you and obtain your consent before renewing at a higher price.

You agree not to:

• Use Grace for anything unlawful, or in breach of these Terms.
• Misrepresent who you are, impersonate anyone, or claim credentials you do not hold.
• Use Grace to obtain, offer, or arrange controlled substances or prescriptions.
• Upload malware, probe or interfere with Grace’s operation, or try to reach data or features that are not yours.
• Scrape, data-mine, or use automated means to access Grace, or copy the community or its content, except with our written permission.
• Reverse-engineer or attempt to derive the source code of the app, except where the law permits it.
• Resell, sublicense, or commercially exploit Grace or any part of it.
• Use Grace to train a machine-learning model, or to build a competing product.

9.1 What we own. Grace — including its software, devotional and editorial content, artwork, the dove, and the Grace and Sunflower Sober names and logos — belongs to Koby Empire, Inc. and its licensors, and is protected by copyright, trademark, and other laws. Scripture translations reproduced in the app remain the property of their respective publishers and are used under their own terms.

9.2 The license we grant you. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Grace for your own personal, non-commercial use.

9.3 Feedback. If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it to improve Grace, with no obligation to you.

10.1 Electronic communications. By using Grace you agree to receive communications from us electronically — in-app messages, push notifications, and email where you have given us an address — and you agree that these satisfy any legal requirement that a communication be in writing.

10.2 Push notifications. You choose whether to allow notifications, and you can turn them off at any time in your device settings or in the app.

10.3 SMS. If you verify a phone number, we send you a one-time verification code by SMS. Message and data rates may apply. We do not send marketing texts.

10.4 Email. If you opt in to email updates, you can opt out at any time in Settings or from the email itself.

Our Privacy Policy explains what we collect, how we use it, and who we share it with — including advertising and analytics partners. It is part of these Terms. By using Grace, you agree to it. If you are not comfortable with what it describes, do not use Grace.

Grace relies on third parties for hosting, authentication, AI responses and content moderation, push delivery, analytics, advertising measurement, subscription management, and customer support. Their own terms and privacy policies govern what they do with information they receive. We are not responsible for third-party services we do not control, or for links to sites and resources we do not operate.

13.1 Licensed, not sold. The Grace app is licensed to you, not sold. Your use must comply with the rules of the app store you downloaded it from.

13.2 Apple. These Terms are between you and Koby Empire, not Apple, and Apple is not responsible for Grace or its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing claims relating to the app, including product liability, failure to conform to legal requirements, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13.3 Google Play. If you obtained Grace from Google Play, your use is also subject to the Google Play Terms of Service.

13.4 Device permissions. Grace asks for permissions it needs — notifications, camera and photo access for posting images, and, on iOS, app tracking permission. You can change any of them in your device settings; some features will not work without them.

If you believe content in Grace infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent: Koby Empire, Inc., Attn: DMCA Agent, hello@sunflowersober.com. Your notice must include every element required by 17 U.S.C. § 512(c)(3). We may remove the content and we terminate repeat infringers.

We may suspend or terminate your access to Grace at any time, with or without notice, if we believe you have broken these Terms or the law, if you present a risk to other members, or to protect Grace. You can stop using Grace and delete your account at any time. Provisions that by their nature should survive termination do — including Sections 9, 11, and 16 through 20.

16.1 As is. To the fullest extent permitted by law, Grace is provided “as is” and “as available,” without warranties of any kind, express or implied. We disclaim the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

16.2 No guarantee of accuracy or availability. We do not warrant that Grace will be uninterrupted, secure, or error-free, that it will work on every device, or that devotional content, scripture selections, AI responses, or anything posted by other members is accurate, complete, or suitable for you.

16.3 Where this does not apply. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

To the fullest extent permitted by law:

• Koby Empire will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or the cost of substitute services, arising from or relating to Grace or these Terms — even if we were advised such damages were possible.
• Our total liability for all claims arising from or relating to Grace or these Terms will not exceed the greater of the amount you paid us in the 12 months before the claim, or $100.
• Nothing here limits liability that cannot be limited under applicable law, including liability for personal injury caused by our gross negligence or willful misconduct. Some jurisdictions do not allow some of these limitations, so they may not apply to you.

You will indemnify, defend, and hold harmless Koby Empire, Inc., its affiliates, and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected to your use or misuse of Grace, your breach of these Terms, your content, or your violation of the law or anyone else’s rights. This does not require you to indemnify us for our own gross negligence or willful misconduct.

Please read this section carefully. It affects your legal rights, including your right to go to court and to bring a class action.

19.1 Talk to us first. Before filing a claim, you agree to try to resolve it informally by emailing hello@sunflowersober.com. If we cannot resolve it within 30 days, either of us may proceed as described below.

19.2 Binding individual arbitration. You and Koby Empire agree to resolve all claims — except those excluded below — through final and binding individual arbitration under the Federal Arbitration Act, administered by the American Arbitration Association under its applicable rules. The arbitrator has exclusive authority to resolve disputes about the interpretation, applicability, enforceability, or formation of this arbitration agreement.

19.3 Class action waiver. YOU AND KOBY EMPIRE AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE THE CLAIMS OF MORE THAN ONE PERSON OR PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.

19.4 How to opt out. You may opt out of this arbitration agreement within 30 days of creating your account by emailing hello@sunflowersober.com with your name, the email or phone number on your account, and a statement that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms.

19.5 What is excluded. Either of us may bring an individual claim in small claims court if it qualifies, and either of us may seek injunctive relief in court to protect intellectual property or the security of data.

These Terms and any dispute arising from them — whether in arbitration or in court — are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and by applicable federal law. Venue for any court proceeding permitted by Section 19 lies in the state or federal courts located in New Castle County, Delaware, and you consent to personal jurisdiction there.

We may change, suspend, or discontinue any part of Grace at any time. We may also update these Terms. When we make a material change, we will give notice — in the app, by email, or by asking you to accept the updated Terms — and we will update the date at the top of this page. Changes take effect when posted unless we say otherwise. Continuing to use Grace after that means you accept the updated Terms. If you do not agree, stop using Grace and delete your account.

You represent that you are not located in, under the control of, or a national or resident of any country subject to a U.S. embargo or sanctions, and that you are not on any U.S. government restricted-party list. You agree to comply with U.S. export control and sanctions laws when using Grace.

23.1 Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and Koby Empire about Grace, and replace any earlier terms for the app.

23.2 Severability and waiver. If any provision is unenforceable, it will be narrowed to the minimum extent needed to make it enforceable and the rest stays in force. Our failure to enforce a right is not a waiver of it.

23.3 Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.

23.4 Notices. We may give notice through the app, by email, or by posting on this site. You may send legal notices to Koby Empire, Inc., Attn: Legal, hello@sunflowersober.com.

23.5 Other Koby Empire apps. Grace is one of several apps we operate. These Terms govern Grace. If you use another of our apps, its own terms govern that app.
